PURPOSE AND SCOPE OF APPLICATION

This document establishes the Terms and Conditions of Use governing access, navigation and use of the digital platform for online training (hereinafter, the Platform), developed and managed by ECOMAR FOUNDATION, whose purpose is to provide users with a virtual environment for the organization, management and delivery of courses, activities, and other online training activities, which may be taught in different modalities and through various technological resources.

These Terms and Conditions of Use apply to all users who access and use the Platform, and must expressly and unreservedly accept these conditions in order to use its services. The use of the Platform implies full adherence to the terms herein, as well as any other particular condition, if any, could be established for the use of certain services or features.

The owner of the Platform reserves the right to modify, update or delete at any time and without prior notice the information contained in these Terms and Conditions, being applicable at all times those that are published and accessible to users on the Platform itself.

CONDITIONS OF ACCESS, REGISTRATION AND USE OF THE PLATFORM

User Registration

To access the services and content offered through the Platform will be necessary to register as a user. The registration process will be carried out by the owner of the Platform or by entities authorized by it, so that the user will receive their access credentials by the established methods, usually email.

In order for the owner of the Platform to be able to register the user and send the credentials, it will be necessary that the user himself has authorized the Platform to do so.

The user guarantees the authenticity and veracity of all data communicated as a result of the completion of the forms, being responsible for keeping them updated at all times. The user shall be solely responsible for any false or inaccurate statements made and the damages that this may cause the owner of the Platform or third parties.

User Obligations

The user agrees to make proper use of the Platform and the services offered therein, in accordance with current legislation, these Terms and Conditions, good customs and public order, refraining from illegal activities, prohibited or harmful to the rights and interests of others.

In particular, and without limitation, the user agrees to:

- Diligently safeguard the access credentials to your personal account, avoiding their disclosure to unauthorized third parties.

- Immediately notify the Platform owner of any unauthorized use of their credentials or any situation that could pose a risk to the security of the Platform.

- Not to access or attempt to access restricted resources or private areas of the Platform without proper authorization.

- Not to introduce or disseminate computer viruses, malware or any other physical or logical systems capable of causing damage or alterations in computer systems, networks, content or data of the Platform.

- Refrain from reproducing, copying, distributing, allowing public access through any form of public communication, transforming or modifying the contents of the Platform, unless expressly authorized by the owner of the corresponding rights.

Age Requirements

The Platform is intended for persons over 18 years. In any case, access to persons under that age will be allowed when they have the express authorization of their parents, guardians or legal representatives, who will be responsible in any case for the use that the minor makes of the Platform.

PLATFORM SERVICES AND FUNCTIONALITIES

Through the Platform, the owner makes available to registered users a digital environment for consultation, registration, participation and use of courses, training activities and online training pills, offering various functionalities, including, but not limited to:

- Display of the catalog of available training courses, including descriptive information, objectives, contents, duration, mode of delivery, cost (if applicable) and registration requirements.

- Procedure for registration and enrollment in selected training activities.

- Access to didactic content in digital format, which may consist of documents, videos, presentations, multimedia resources, external links and other training materials.

- Participation in interactive activities, discussion forums, chats, virtual tutorials or live sessions, when provided for in the course methodology.

- Consultation of training progress, grades (when applicable) and downloading of certificates or accreditations in those courses that so provide.

Each training action may have specific conditions that will be informed prior to registration, and the user must expressly accept them in order to formalize his/her enrollment.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All intellectual and industrial property rights on the contents, graphic design, navigation structure, databases, software, logos, trade names, trademarks and any other elements that are part of the Platform are the exclusive property of the owner of the Platform or, where appropriate, third parties who have authorized their use, being protected by current legislation on intellectual and industrial property.

The total or partial reproduction, distribution, public communication, making available, transformation or any other form of exploitation of these elements is expressly prohibited without the prior, express and written authorization of the owner of the corresponding rights.

The user may only view, download and print the contents of the Platform for personal and non-commercial use, provided that the distinctive signs, copyright notices or any other indication of ownership are not altered, modified or removed.

Any unauthorized use shall be considered an infringement of the intellectual and industrial property rights of the Platform owner, who reserves the right to take appropriate legal action.

PROTECTION OF PERSONAL DATA

The owner of the Platform undertakes to process the personal data of users in strict compliance with the provisions of Regulation (EU) 2016/679 of 27 April, General Data Protection (RGPD), in the Organic Law 3/2018 of 5 December, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), and other applicable regulations.

Personal data provided by users through the Platform will be processed in accordance with the following:

Purpose: Management of user registrations, enrollment in courses and training activities, academic monitoring, issuance of certificates, attention to queries and informative or commercial communications related to the services offered through the Platform.

Legitimation: Consent of the interested party, execution of a contractual relationship and compliance with legal obligations.

Recipients: No data will be transferred to third parties unless legally required or with the express consent of the user.

Rights: Users may exercise their rights of access, rectification, deletion, opposition, limitation and portability through the form 'Exercise of Data Protection Rights', available on the website.

LIMITATION OF LIABILITY

The owner of the Platform does not guarantee the availability, continuity or infallibility of the operation of the Platform, which may be affected by interruptions, technical failures or updates necessary to improve the service, assuming no responsibility for any damages that such incidents may cause to users.

Likewise, it shall not be liable for damages that may arise from:

- The improper use of the Platform by users.

- Infringement by users of intellectual, industrial or data protection property rights.

- Computer viruses, cyber-attacks or unauthorized access that may occur, despite reasonable security measures having been taken.

- Errors or omissions in the didactic contents, although it is committed to correct them as soon as it becomes aware of them.

MODIFICATION OF CONDITIONS

The owner of the Platform reserves the right to modify, at any time and without prior notice, these Terms and Conditions of Use, as well as any other particular conditions that may be applicable.

The new conditions will be notified to users by publication on the Platform, replacing from that moment to those previously in force. Continued use of the Platform by the user once the modifications have been published will imply acceptance of the new conditions.

APPLICABLE LAW AND JURISDICTION

These conditions are governed by Spanish law in force at all times. For the resolution of any dispute, controversy or claim arising from the use of the Platform, the parties expressly submit to the Courts and Tribunals of Madrid, unless the regulations on consumers and users establish other mandatory jurisdiction.
